In this meeting you will be asked questions about yourself and your fiancee to better understand your case. The reason for this is to gather information and discover any potential issues so they can be dealt with and they do not delay the approval of the petition.

2. Assists ONLY YOU in completing your package to the USCIS for approval.

This packet contains detailed instructions on the documents and forms which are required to file the I-129F petition.

3. Preparation and assembly of the I-129F petition.

Here, the law firm looks for any possible red flags, and handles any issues in order to get the petition processed in the shortest time possible. Once this is completed, we will express mail the document to you for your signature. After signing, you will then express mail the document back to the practice in an enclosed express mail package. Then, upon receiving the package, Mrs. Jones will express mail the documents to the USCIS service center for processing.

When you meet a lady in another country and become engaged, the fiancee visa allows her to enter the United States and live with you for a period of 90 days. Before this time period expires, you and your fiancee must be married, or she must leave the country. This visa allows you two the time needed to get to know one another, and for her to become adjusted to life in the U.S.

During this 90 days, you will be responsible for her financial support while she is in the country. An extension period past the 90 day visit is not allowed.

To petition for a fiancee visa you must submit a petition for an Alien Fiancee (Form I-129F) and send it to one of the 4 service centers in the United States, located in

1. California
2. Nebraska
3. Texas
4. Vermont

The application must be mailed to the correct USCIS service center because they are not equipped to handle walk-in applications or respond to questions at these locations.

To be eligible for a fiancee visa
1. You must be a U.S. citizen.
2. Your income level must be 125% of the current United States poverty level.
3. Your fiancee must not have committed any previous immigration law violations, nor have a criminal record.
4. If you were born in the United States, proof of U.S. citizenship may be provided through a copy of your birth certificate
   (front and back).
5. If you are a naturalized citizen, then you will need to provide the USCIS a copy of your Certificate of Naturalization.
6. If either of these copies are not available, you may also provide school records, census records, or Baptismal certificate, or
   affidavits.
7. You must have met your fiancee in person during the last 2 years, and both of you are legally free to marry.

Supporting documents of your income level
1. A written statement from your employer
2. Your bank records
3. A listing of specific assets
4. Your last 3 years of tax returns

For children of your fiancee, they may enter the U.S. with a K-2 visa. For the child to gain residency, you and your fiancee must marry before the child's 18th birthday. If no marriage occurs between you and fiancee within the 90 days time period, the child must accompany her Mother back to their home country.

Usually your fiancee will have an interview at the American Consulate. Her child may or may not have to attend as per the circumstances. The issuance date of a K-2 visa must be within 1 year from the date that the Mother's fiancee visa was issued. Both the K-1 and K-2 visas are valid for one entry into the United States with six months of the date of issuance.


What is needed for a K-2 Visa (Visa for your fiancee's child)
1. Valid Passport (If the child is under 16, this is not required)
2. Non-immigrant Visa application (Form DS-156) in duplicate with two current color photos
3. Official Birth Certificate
4. Must obtain permission from the child's other parent.
5. Complete medical examination report

With a K-2 Visa the child may
1. Live in the United States for 90 days, or until his/her mother is married.
2. Study in the U.S.
3. Apply for permission to find work in the U.S.
